IDNTY Clothing LLC Terms of Use

1. Acceptance of Terms

By accessing or using the IDNTY website, mobile app, or any related product or service ("Platform") on any device ("Device"), you agree to these Terms of Use and applicable laws. If you disagree with any part of these terms, do not use the Platform. IDNTY may modify these terms at any time, and continued use constitutes your acceptance of any updates.

 

 

2. Important Notices

Amateur Athlete Advisory

Using this Platform could affect your amateur status. It’s your responsibility to check with your athletic association. IDNTY is not liable for any resulting ineligibility.

Physical Activity Warning

Features promoting physical activity carry risk. Consult your doctor before engaging. IDNTY is not liable for injuries from participation.

 

 

3. Intellectual Property

All content (except user-generated content) is owned or licensed by IIDNTY Clothing LLC and protected by copyright, trademark, and other laws. This includes text, images, videos, graphics, and more. Use is restricted to personal, non-commercial purposes. No content may be copied, modified, or distributed without prior written permission.

 

 

4. Platform Use Rules

You agree not to:

  • Alter or remove copyright or proprietary notices.

  • Use data mining or automated tools.

  • Republish, distribute, or exploit content without consent.

  • Interfere with the Platform’s operation or security.

 

 

5. Orders and Returns

Product Orders

Orders are subject to acceptance. IDNTY may cancel any order at its discretion. If already charged, a full refund will be issued.

Returns & Exchanges

Standard Products:

  • Returns: Free within 30 days of delivery. Items must be unworn, unwashed, and with tags.

  • Exchanges: Free within 45 days for a different size, color, or store credit.

Final Sale Items & International Orders: Not eligible for return or exchange.

Limited Edition Products: All sales are final. No returns, exchanges, or cancellations allowed.

 

 

6. Color Accuracy

Product colors may vary slightly based on your device display. IDNTY is not responsible for color variation disputes.

 

 

7. Account Security

You're responsible for all activity under your account. Keep your credentials confidential. IDNTY is not liable for unauthorized account access.

 

 

8. User Generated Content (UGC)

Posting Guidelines:

  • Be respectful, relevant, and lawful.

  • Don’t share personal data, solicit info, or use the Platform for commercial gain.

  • Only post content you own or have permission to use.

  • Do not impersonate others or misrepresent yourself.

Rights Granted to IDNTY:
 By posting UGC, you grant IDNTY a royalty-free, perpetual license to use, reproduce, and distribute your content for any purpose.

Content Monitoring:
 IDNTY does not pre-screen UGC but may remove or refuse content at its discretion. IDNTY disclaims liability for user conduct or posted content.

 

 

9. Eligibility and Registration

Users must be at least 13 years old. Providing false information or misrepresenting your age may result in account termination.

 

 

10. Copyright Complaints

11. Third-Party Links

IDNTY Clothing LLC is not responsible for content or policies on external websites linked through the Platform.

 

 

12. Mobile Services

Using IDNTY mobile features may incur charges from your carrier. By opting in to SMS services, you consent to receive recurring messages. To opt out, reply STOP.

 

 

13. Indemnification

You agree to defend and hold IDNTY harmless from any claims or liabilities arising from your use of the Platform or violation of these Terms.

 

 

14. Privacy

Refer to our Privacy Policy for information on how we collect and use your data.

 

 

15. Disclaimers and Limitations

  • Platform and content are provided “as is,” with no guarantees of performance or availability.

  • IDNTY is not liable for indirect, incidental, or consequential damages.

  • Your sole remedy is to stop using the Platform.

  • Maximum liability is limited to $100.

 

 

16. Legal Jurisdiction

These Terms are governed by Minnesota law. Any disputes must be resolved individually in state or federal courts located in Ramsey County, MN. You waive any right to participate in a class action.

 

 

17. Severability

If any provision is found unenforceable, the rest remain in full effect.

 

 

18. Termination

IDNTY may suspend or terminate your account at any time without notice. Certain provisions (e.g., intellectual property, indemnification, and limitations of liability) will survive account termination.

 

 

19. Mobile Terms of Service

IDNTY’s mobile messaging service allows you to receive promotional and account-related texts. Message frequency may vary. Message and data rates may apply. You may opt out at any time by texting STOP. For help, text HELP or email Dyverson.co@gmail.com. Your carrier is not responsible for delayed or undelivered messages. Always keep your contact information up to date.
